In the current climate, Post-Covid we are told to stay at home if we are unwell and get tested – unless it is Christmas time and your employer advises that you can’t take sick leave, as was the case with jewellery retailer Pandora, this week.
Whilst the company has hastily tried to distance their corporate view from these statements, the damage has been done and the matter is out there for all and sundry to read about. It also highlighted the sentiment that this is a prevailing issue alongside chronic understaffing in the retail sector, which leads employees to feel obligated to come in when unwell, as to not let their colleagues down.
Under the Health & Safety at Work Act (2015) employers have a responsibility to protect the health and safety of their workforce. We all have a responsibility to keep our community safe. Employees have the right to take leave from work if they are unwell or a dependent or partner is unwell or injured and they need to care for them.
Sick leave as a statutory minimum will increase to 10 days by the end of 2021 after six months of service – and employees cannot be denied the right to take up their entitlement, if they need to.
